www.digiswitch.id Digiswitch.id is a website operated by PT. Digiflazz Interkoneksi Indonesia. By accessing this website or by becoming a member, you acknowledge and agree to the terms and conditions stated below.

We may add to, change, or remove these terms and conditions at any time without prior notice. You should read the terms and conditions regularly. www.digiswitch.id Your continued use of this website after a change means you accept the latest terms and conditions.

  • Definitions
    1. PT. Digiflazz Interkoneksi Indonesia is a limited liability company that operates the digiswitch.id web portal, a top-up server that provides top-up server setup services. It is referred to in this document as "Digiswitch".
    2. www.digiswitch.id is the official Digiswitch website.
    3. "User" means a party that uses the Digiswitch website, including but not limited to a Tenant, an Agent, or any other visitor to the Digiswitch website.
    4. "Tenant" means a user who works directly with Digiswitch.
    5. "Agent" means a user who registers on a Tenant website and buys goods offered by the Tenant.
    6. "Tenant Website" means a website owned by a Tenant that Digiswitch has created.
    7. "Goods" means intangible (digital) items that can be delivered through the Digiswitch system from the Tenant to the Agent.
    8. "Subscription Fee" means the fee that Digiswitch charges the Tenant for top-up server services.
    9. "Transaction Fee" means the fee that Digiswitch charges the Tenant when the Tenant's transaction uses a supplier other than Digiflazz.
    10. "Digiswitch Deposit" means money that the Tenant deposits to Digiswitch.
    11. "Official Digiswitch Account" means the account agreed between Digiswitch and the Tenant for payment of the Subscription Fee and other Digiswitch charges. The official account list can be seen at the page https://digiflazz.com/docs/article/1o6yg8 .
    12. "Terms and Conditions" means the agreement between the Tenant and Digiswitch that sets out the rules that manages the rights and obligations of each party.

  • License to Use
    1. The Tenant may manage and market its Tenant Website.
    2. The Tenant may not lease or resell the Tenant Website.
    3. Users may not use Digiswitch to commit crime, fraud, or any other unlawful act. Digiswitch is not responsible for goods distributed by users and may take firm action, including disabling a user's account, when evidence of any unlawful act is found.

  • Fees
    1. The Tenant pays an initial fee as stated on the Digiswitch.id website. The full initial fee becomes the Digiswitch Deposit. Any later Deposit top-up must be at least as much as the Subscription Fee for 30 days.
    2. Each day, the Tenant is charged the Subscription Fee at the amount stated on the Tenant Website. The fee is deducted from the Digiswitch Deposit.
    3. Any shortfall in the Subscription Fee that the Tenant does not pay is carried over to the next day.
    4. Agent transactions cannot be made when the Digiswitch Deposit is negative.
    5. The Digiswitch Deposit cannot be refunded or returned.
    6. Digiswitch does not accept deferred payment or settlement schemes.
    7. Digiswitch may change the Subscription Fee at any time with one-day notice. The change may result from, but is not limited to: (i) changes in the US dollar exchange rate; (ii) very high Tenant transaction volume; and other factors.
    8. If the Tenant does not pay the Subscription Fee within 24 hours after the due date without confirmation from the Tenant, Digiswitch may change the static IP provided by Digiswitch.
    9. If the Tenant does not pay the Subscription Fee for 3 months, all Tenant data may be deleted. The Tenant must then pay the initial fee again to use Digiswitch services.
    10. Digiswitch charges the Transaction Fee when the Tenant uses a supplier other than Digiflazz, according to the prices on the Tenant Website. The Transaction Fee is deducted from the Digiswitch Deposit.
    11. The Transaction Fee applies to successful transactions. A transaction that first succeeds and is then cancelled still incurs the Transaction Fee.

  • Account, Balance, and Security
    1. The Tenant is personally responsible for keeping its account and password confidential and for all activity that happens under the Tenant's account.
    2. Digiswitch is not responsible for loss caused by the Tenant's failure to protect access rights.
    3. Digiswitch never asks for the email, password, or OTP code of a Tenant account for any reason. Digiswitch advises Users not to give this data or other important data to any party that claims to represent Digiswitch or to any other untrusted party.
    4. Digiswitch does not and will not share any User information with any party without the User's consent.
    5. Users may not create or use any device, software, feature, or tool that manipulates the Digiswitch system, including but not limited to: (i) Tenant data manipulation; (ii) crawling or scraping; (iii) automated activity in transactions, promotions, and similar actions; and (iv) other actions that may reasonably be judged as system manipulation.

  • Prices
    1. All prices shown on the Digiswitch website are in Rupiah.
    2. Goods prices are set by the Tenant.
    3. The Tenant is fully responsible for any price-setting error.

  • Technical Support
    1. The Tenant receives technical support from Digiswitch on working days and hours: Monday to Friday, 10.00-18.00 GMT+7, through chat, telephone, or email.
    2. Digiswitch will keep developing its services over time to give Users a better experience.

  • Taxes
    1. Users and Digiswitch agree to fulfill their own tax obligations according to the tax laws and regulations that apply in Indonesia.
    2. Digiswitch will issue a tax invoice for the monthly Subscription Fee to the Tenant.
    3. The Subscription Fee and the Transaction Fee include Value Added Tax (VAT).

  • Indemnity
    Users release Digiswitch from liability and will keep Digiswitch (including its parent company, directors, and employees) safe from any claim or demand, including reasonable legal costs, made by a third party because the User breached these Terms, misused Digiswitch services, or violated the law or the rights of a third party.

  • Governing Law
    These Terms and Conditions are managed by the laws of the Republic of Indonesia.

  • Disclaimer of Warranties and Limitation of Liability
    Digiswitch is a web portal that provides top-up server setup services. Transactions happen between the Tenant and the Agent. Users understand that Digiswitch's liability is proportionate as the provider of the web portal service.

    Users agree that they use Digiswitch services at their own risk and that the services are provided "AS IS" and "AS AVAILABLE". Digiswitch does not warrant that the service will be uninterrupted or error-free.

    If you have a dispute with one or more Users, you release Digiswitch (including its parent company, directors, and employees) from claims and demands for damages and losses (actual and implied) of any kind and nature, known or unknown, that arise from or relate to that dispute. By agreeing, you waive any legal protection (under any law or regulation) that would limit this release.

    To the extent permitted by applicable law, Digiswitch (including its parent company, directors, and employees) is not liable, and you agree not to hold Digiswitch liable, for any damages or losses (including but not limited to loss of money, reputation, profit, or other intangible losses) caused directly or indirectly by:
    • Use of, or inability to use, the Digiswitch services.
    • Prices or other instructions available in the Digiswitch services.
    • Delay or interruption in the Digiswitch services.
    • Negligence and losses caused by each User.
    • Breach of intellectual property rights.
    • Disputes between Users.
    • Defamation of another party.
    • Any misuse of Goods bought by an Agent.
    • Loss from unofficial payment to any party other than the Official Digiswitch Account, including any party acting on behalf of Digiswitch, or from a wrong account number or other information, or from bank error.
    • Viruses or other malicious software obtained by accessing or connecting to the Digiswitch services.
    • Any disruption, bug, error, or inaccuracy in the Digiswitch services.
    • Damage to a User's hardware from the use of any Digiswitch service.
    • Content, actions, or omissions of third parties, including suspected counterfeit Goods on the Digiswitch website.
    • Enforcement action taken in relation to a User's account.
    • Hacking by a third party against a User's account.

  • Force Majeure
    1. In these Terms, "Force Majeure" means an event beyond normal human ability to prevent, including but not limited to accidents, natural disasters, riots, fire, flood, explosion, mass strike, war, embargo, changes in laws or regulations, changes in government policy, and any other event beyond the parties' control that prevents a party from performing its obligations under these Terms, including events that the party could prevent but that would cause it very great loss.
    2. In a Force Majeure event, each party must notify the other within 3 x 24 hours after the event begins.
    3. If a Force Majeure event prevents one party from performing its obligations under these Terms, the affected obligations are extended for the duration of the Force Majeure event, without reducing the obligations under these Terms.
